These Terms and Conditions ("Terms") govern your access to and use of the website located at ashleyriverorthodontics.com (the "Site"), along with any related services, communications, and text messaging programs offered by Ashley River Orthodontics ("we," "us," or "our"), an orthodontic practice led by Dr. Sarah McKee and located at 811 St Andrews Blvd, Unit C, Charleston, SC 29407. By accessing or using the Site, or by opting in to receive communications from us, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. Use of the Site
You may use the Site for lawful, personal, non-commercial purposes only. You agree not to:
-Use the Site in any way that violates applicable law or regulation.
-Attempt to gain unauthorized access to any portion of the Site, its servers, or related systems. Interfere with or disrupt the operation of the Site, or introduce malicious code.
-Copy, scrape, harvest, or collect information from the Site through automated means without our permission.

If you submit information through the Site, you represent that you are at least 18 years of age, or that you are using the Site with the involvement and consent of a parent or legal guardian.

2. No Medical Advice; No Provider Relationship
The content on the Site is provided for general informational purposes only and is not intended as, and should not be relied upon as, medical, dental, or other professional advice. Viewing the Site, submitting a form, or communicating with us through the Site or by text message does not create a doctor-patient relationship. You should always seek the advice of Dr. McKee or another qualified healthcare provider with any questions about a condition or treatment. 3. Text Messaging (SMS) Terms
By opting in, you agree to the following terms governing our text messaging program. These Terms supplement, and should be read together with, our Privacy Policy.
-Program description and consent
When you provide your mobile phone number and opt in (through our Site forms, our new patient and consent forms, in our office, or by texting our office number), you consent to receive text messages from Ashley River Orthodontics. Consent to receive text messages is not a condition of purchasing any product or receiving any orthodontic service.
-Types of messages and frequency
Messages may include appointment reminders and confirmations, scheduling communications, treatment and account updates, billing and insurance notifications, and general communications from our office. Message frequency varies based on your interactions with our office and your appointments.
-Costs and delivery
Message and data rates may apply, depending on your mobile carrier and plan. Mobile carriers are not liable for delayed or undelivered messages.
- Opt-out and help
You can cancel text messages at any time by replying STOP to any message you receive from us. After you send STOP, you will receive one final confirmation message, and no further texts will be sent unless you re-enroll. For help, reply HELP or contact our office at (843) 410-3471.

Privacy of your mobile information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text messaging services that help us deliver the messages you have requested.

4. Appointments and Communications
Appointment reminders and confirmations we send by text, email, or phone are provided as a courtesy. You remain responsible for keeping track of and attending your scheduled appointments, and for following our office scheduling, cancellation, and financial policies, which may be provided separately.

5. Intellectual Property
All content on the Site, including text, graphics, logos, images, and design, is owned by or licensed to Ashley River Orthodontics and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written permission. "Ashley River Orthodontics" and our logos are our trademarks and may not be used without authorization.

6. Third-Party Links
The Site may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party site, and providing a link does not imply endorsement. Your use of any third-party site is at your own risk and subject to that site's terms.

You agree to indemnify and hold harmless Ashley River Orthodontics and its owners, providers, and staff from any claims, damages, losses, or expenses, including reasonable attorneys' fees, arising out of your misuse of the Site or your violation of these Terms.

11. Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Charleston County, South Carolina.

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and post the current version on the Site. Your continued use of the Site or our services after changes are posted constitutes acceptance of the updated Terms.
